Berhampur:After a legal battle at District Consumer Disputes Redressal Commission(DCDRC),Ganjam,one Sarojini das(59)of Madhuachuan village under Rmbha PS limits in Ganjam district has received the insured money against her deceased husband Sujya das.Sujya took a life insurence policy from SBI Life Insurance Co Ltd(SLICL),Berhampur in May 2017,for a sum of Rs ten lakhs.Accordingly,Sujya paid the 1st premium of Rs.45300/-and received the policy bond.However,due to illness,Sujya died on 27/10/2028.Thereafter Sarojini filed death claim application for assured amount of Rs ten lakhs along with supported documents before the SLICL,Berhampur.But the SLICL repudiated the claim of Sarojini on 19/6/2019 with a reason `the policy stands cancelled`,as Sujya did not disclosed details of his other life insurence policies.Since there was no rule to restrict to obtain more policies,Sarojini being the nominee filed a case before DCDRC,alleging defficiancy of service by the SLICL,praying for insured amount with compensation. Accordingly the DCDRC admitted the appeal and issued notice to SLICL.The SLICL,however failed to justify its denial for payment of insured money.The DCDRC Coram,president(I/C)Satish panigrahy and member Smt Saritri pattanaik on 3/3/2025 in their order stated that the SLICL has failed to discredit the claim of Sarojini.The Coram also directed the SLICL to pay the insured amount of Rs ten lakhs with interest @ 9% per annum from the date of repudiation of the death claim from june 2019 together with litigation cost of Rs 7,000/-to Sarojini with in 45 days from the date of receipt of the order,failing which all the dues shall carry interest @ 12% per annum till realisation of the amlount.The order stated that Sarojini is at liberty to take appropriate steps in accordance to the consumer protection act 2019 for the realisation of the amount.The DCDRC also provided copy of the judgement to the SLICL and Sarojini.As per order,the SLICL at the DCDRC has handed over a cheque of Rs 14.81 lakhs towards insured money,compensation and litigation charges to Sarojini.
