Parlakhemundi,(Tarini Prasad Panda): Hearing the sensitive case of kidnapping and raping a tender-minded child on the pretext of giving him chips, today, Gajapati District Additional District Sessions Judge Bibhu Prasad Panda convicted the accused Balaram Nayak alias Bala (60 years) of Valia Sahi under Mohana police station under Section 6 of the POCSO Act and sentenced him to 20 years of rigorous imprisonment with a fine of Rs. 10,000. In default of payment of fine, he will have to undergo another six months of rigorous imprisonment, the Hon’ble Judge mentioned in his verdict. Similarly, the accused has been convicted under Section 363 of the Indian Penal Code for kidnapping and sentenced to three years of rigorous imprisonment with a fine of Rs. 1,000 and will have to undergo two months of rigorous imprisonment in default of payment of fine, the Honorable Judge mentioned in his judgment. In this sensitive case, the judge in his judgment has ordered the District Legal Services Authority to pay four lakh rupees as compensation to the victim and mentioned that the entire amount of fine should be paid to the victim. Special Public Prosecutor M. Prithviraj has successfully handled the case on behalf of the government, informed the in-charge Cadre Public Prosecutor Rajesh Kumar Mishra.
As per information on 28-03-2024, in the evening, the mother of the victim and her daughter were sitting in Pindha. Later, the mother went into the house for some work and found that her daughter was no longer there. While searching around, she got news that the accused was standing near a shop holding her daughter to buy her kurkura chips. After searching around suspiciously, when she went inside a thicket of rocks at the end of the village, she was stunned. At that time, Mudala had stripped her tender-hearted daughter naked and was sitting on her in an uncomfortable position. Later, when she screamed loudly, the villagers reached there and caught the accused and rescued the girl in an unconscious state. Therefore, her mother did not waste time and admitted her daughter to Mohana Hospital for treatment and filed a case at Mohana Police Station on 29-03-2024, which was registered as case number 74. Keeping in view the seriousness of the case, Sub-Inspector Jayanti Purti investigated the case and tried the accused in court. Today, based on the evidence of 26 strong witnesses and 17 documents, the Honorable Judge has finally given this landmark verdict.
